Conditions of entry for the "Win a Canyon EMTB Challenge Gear Bundle" online competition

The organizer of the online competition is Canyon Bicycles GmbH (hereinafter known as CANYON), Karl-Tesche-Str. 12, D-56073 Koblenz.

Anyone who is at least 18 years of age may enter the competition with the exception of employees of Canyon Bicycles GmbH, their families or employees of agencies involved in the organization of the competition.

Entering the competition is free of charge.

The period for entering shall commence on 26th of February 2021 and end on 29st of March 2021 at 02:00 PM CET.

Each entrant may only enter the competition once.

The winner shall be selected by chance in a draw.

The prize: One winner will receive the prize. The prize is one Canyon Signature Pro MTB Rain Jacket and one Canyon Signature Pro MTB Pant. The size can be chosen by the winner.

To join the competition, the user has to:

A. Post a picture or a video of him joining the Canyon E-MTB challenge “How many meters can you climb in one hour” on the competition hashtag #powerongameon on Instagram and tag @canyon.

The winner shall be notified by CANYON after the 29th of March 2021 per email, and the name may be published on CANYON's portals and/or the websites of its joint venture partners. The winner hereby expressly agree to this form of publication. CANYON shall be entitled to send the winners' details to its joint venture partners so as to enable them to deliver the prizes. If a winner fails to make contact with his or her complete mail address within four weeks of notification, all claims to the prize shall be voided and a new winner will be selected by a draw. Claims to the prize shall also be voided if it is not possible to deliver the prize within 9 months of the initial notification about the prize for reasons for which the winner is responsible.

No winner shall be entitled to demand the prize be paid in cash or a substitute prize be awarded. The prize may not be assigned and shall be non-transferable.

Entering using a competition service or using automated competition bots or other means of manipulation shall not be permitted. CANYON reserves the right to exclude the entrant from the competition in the event of a rule being breached.

CANYON also reserves the right to exclude or disqualify entrants from the competition and not to award the prize or to cancel the prize and demand its return in the following circumstances:

• Entrants who are not private individuals in the legal sense,
• Entrants under the age of 18 or cannot provide evidence that they are over the age of 18,
• Entrants who are employed by CANYON or by an affiliated company or by other companies which are involved in the competition and their immediate relatives (partners, parents, siblings and children) and members of the households of said employees.
• Entrants who attempt or actually manage to enter multiple times in each competition period,
• Entrants who use banned tools or attempt to gain an advantage for themselves by other means of manipulation,
• Entrants who have provided false personal details,
• Entrants who cannot be reached using the entered contact details or who do not respond to the winning notification from CANYON within the period specified in the competition,
• Entrants who breach these conditions of entry.
• In the event of an exclusion or disqualification, CANYON shall conduct another draw to select a new winner for the prize from the other entrants.

In addition, the following posts, comments, shares and tweets shall be excluded from the competition:

• which are insulating, derogatory or discriminatory.
• which glorify violence, are xenophobic, pornographic or racist.
• with political content.
• with advertising content.
• which are otherwise illegal or breach the rights of third parties.

This competition is not connected in any way whatsoever to Facebook or Twitter and is in no way sponsored, supported or organised by Facebook or Twitter. The recipient of the information provided shall not be Facebook or Twitter but CANYON. The information provided shall only be used for identifying and contacting the winner.

CANYON shall only accept liability for damage caused by CANYON or one of its agents maliciously or through gross negligence or by the negligent breach of duties which are of major important for the achievement of the aim of the contract. These restrictions shall not apply to damage cases of death, personal injury and/or health impairment. The above limitations of liability shall in particularly be applicable to damages caused by errors, delays or interruptions in the transmission, faults in the technical systems and the service, incorrect content, loss or deletion of data or viruses.

CANYON reserves the right to stop, amend or end the competition at any time without notice and without giving reasons. CANYON shall in particular exercise this right if the competition cannot be staged correctly for technical reasons (for example viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons. If such termination is caused by the actions of an entrant, CANYON may demand compensation from this person for the damages suffered.

Entry to the competition shall constitute the complete and unconditional agreement and acceptance of these conditions of entry.

CANYON shall not provide any information on the organization of the competition.

The registration details shall be saved by CANYON in compliance with the statutory regulations for the duration of the competition and distribution of prizes and, for the purposes of distributing the prizes, may send them to its joint venture partner or to the agency supporting the joint venture partner which may also save the registration details for the duration of the competition and distribution of the prizes. The competition shall be subject exclusively to the laws of the Federal Republic of Germany. Questions or complaints relating to the organisation of the competition should be sent within 14 days of becoming aware of the reason in writing, quoting the competition, to Canyon Bicycles GmbH, Karl-Tesche-Str. 12, 56073 Koblenz or by email to: social@canyon.com. Complaints made by telephone or submitted too late cannot be taken into consideration.

Concession of rights

The tester agrees to document his test experience through texts, images and video material and to make it available for further publishing, for example on the Canyon website or in social media networks.
Insofar as copyright rights of use, ancillary copyright, personal rights or other rights have arisen and are still being created through participation in the test program, Canyon shall retain all exclusive and transferrable usage rights at the time they arise for the comprehensive and worldwide evaluation of the production and / or the work or the Service without time, content or location restrictions or transfers all ancillary copyrights (including remuneration claims, if assignable), also for unknown types of use. This includes, the right to broadcast, present, reproduce, retrieve and online, right to edit and distribute, as well as the right to repeat it as often as required.
